Apostille Requirement for OCI Applicants in Canada
If you are applying for an OCI Card in Canada, apostille is required for certain civil documents when those documents are used to prove Indian origin, parentage, marriage, spouse eligibility, identity change, or legal family status.
OCI is generally for foreign citizens of Indian origin. This includes Canadian passport holders who were previously Indian citizens, Canadian citizens born to Indian-origin parents, minors with Indian-origin parents, and foreign citizens applying through an Indian-origin spouse. Indian passport holders living in Canada as PR holders, work permit holders, students, visitors, or other visa-status residents are normally Indian nationals abroad, not OCI applicants.
For OCI purposes, apostille must be obtained when the submitted birth certificate, marriage certificate, divorce order, custody order, death certificate, or name-change document needs official authentication for use by Indian authorities.
Apostille is especially important in the following cases:
- If the applicant is applying through Indian-origin parents, the birth certificate must show both parents’ names.
- If the birth certificate was issued outside India and Canada, it must be apostilled or properly attested as required by the OCI checklist.
- If the applicant is applying on spousal grounds, the registered marriage certificate must be submitted and must be apostilled or attested according to the country of issue.
- If a Canadian birth certificate is required under the spousal-ground OCI category, the live birth certificate must be apostilled by Canadian authorities.
- If the applicant is a non-Canadian passport holder living in Canada, valid Canadian status such as PR, work permit, study permit, or visa must be provided along with the OCI file.
Once a Canadian document has a valid apostille from the competent Canadian authority, it does not require further legalization from the Indian Consulate in Canada.
How to Apply for OCI in Canada with Apostilled Documents
To apply for an Overseas Citizen of India (OCI) card using Canadian civil documents, you must have them apostilled by Global Affairs Canada or a provincial authority before submission.
Process Steps OCI Application Process for Canada
Step 1: Obtain the Correct Long-Form Document
You must provide official, registered Canadian civil certificates. Short-form, church, or ceremonial certificates are not accepted.
- Birth: Must be the long-form certificate listing both parents’ names.
- Marriage: Must be the government-issued official registration certificate.
- Other Legal Documents: Divorce orders, custody papers, name-change certificates, or death certificates must be official court or civil records.
Step 2: Get the Canadian Document Apostilled
Any Canadian civil document used to prove Indian origin, parentage, marriage, or legal status must be apostilled.
Secure the apostille from Global Affairs Canada (GAC) or the competent provincial apostille authority where the document was issued.
Note: Under the Hague Convention, an apostilled Canadian document does not require further legalization by the Indian Consulate.
Step 3: Complete the Online OCI Application
Fill out the OCI application form on the official Government of India portal.
Upload the scanned copies of your passport, photos, and the apostilled Canadian documents into the portal.
Step 4: Book an Appointment and Submit at BLS Canada
Schedule an in-person appointment at your designated BLS International Centre jurisdiction.
Mandatory Rule: You must submit your physical application file, original documents, and copies in person to complete required biometric enrollment.
Why Use GloboPrime to Apostille Your Canadian Documents for OCI?
OCI applications can face delays or correction requests when supporting documents do not match the checklist requirements, such as submitting the wrong birth certificate format, missing parent details, or using an incorrect apostille route. For example, BLS OCI guidance references a Statement of Live Birth Certificate reflecting both parents’ names for certain OCI files.
At GloboPrime, we review your Canadian documents before submission and help ensure they are prepared correctly for OCI application use. Our team checks the document type, issuing authority, certificate format, and apostille requirements before your BLS appointment or OCI submission.
What We Do for You
OCI Document Pre-Check
We review your Canadian birth certificate, marriage certificate, or supporting civil document against the relevant OCI document requirements. If the certificate format, parent details, registration information, or document condition may cause an issue, we identify it before submission.
Correct Canadian Apostille Routing
Canada does not use only one apostille office for every document. Apostilles may be issued by Global Affairs Canada or by designated provincial competent authorities, depending on the document and jurisdiction. GloboPrime helps route your document to the correct authority so you avoid sending it to the wrong office.
End-to-End Apostille Support
We guide the process from document review to notarization if required, authentication or apostille submission, status follow-up, and completed document return. This helps reduce avoidable delays caused by missing steps or incorrect paperwork.
Prepared for OCI, India, and International Use
Once a Canadian document is apostilled by a recognized Canadian competent authority, further attestation or legalization by the Indian Consulate in Canada is generally not required.
